Assessment of evidence

Section 154 of the Evidence Act provides discretion to the Court to permit a party to put questions to its own witness, which are usually put in cross-examination by the adverse party. When it appears to the Court that i the witness is not supporting the case of the party who brings him to the witness box and bears unfavourable evidence being gained over by the adverse party or is not supporting its case due to faulty memory, the Court has been given the discretion to allow such a party to cross-examine its own witness after declaring him hostile.
