Investigating Officer’s Delay in Examining Witnesses

The delay in examining some of the P.Ws. by the Investigating Officer. The P.C. and P.R. of the appellant are nil and as such, he was not a habitual of- fender-The Appellate Division held that the delay in examining some of the P.Ws. by the Investigating Officer, Appellate Di- vision finds that the attention of the wit- nesses was not drawn in this regard and as such, they could not explain the cause of delay. The Investigating Officer, however, stated in cross-examination that he ex- amined most of the witnesses after about two months of the date of occurrence. Having considered the facts and attending circumstances, Appellate Division is of the view that the delay was not inordinate.
