The Government Servants (Special Provisions) Ordinance, 1979

Section 4(a)

Writ petitioner was appointed as an auditor in the Thana Accounts Office, Chakaria, Cox's Bazar who was dis- missed from service under section 4(a) of the Government Servants (Special Provisions) Ordinance, 1979 on the ground of negligence of duty. Section 4(A)-The plaintiff were dismissed under section 4(A) of the Ordinance from their respective service by following the procedure and in exercise of the powers with reference to the Ordinance, which is applicable for the government servants. The Regulation of BCSIR has not been included to the schedule of the Administrative Tribunal Act and, as such, there is no bar to file the suits in the civil court.
