Article 98 Since 1962 prerogative writs were omitted and the constitutional jurisdiction to issue necessary orders on an application was conferred on the High Court (Division) in its own terms.

Article 98(2)(b) read with Constitution of Bangladesh, 1972 Article 102(2)(b)(i)-The language of Article 98 of 1962 Pakistan Consti- tution which has been imported into Article 102 of Bangladesh Constitution of 1972 has been couched in such a manner which is untrammeled by the formalities or technicalities of either section 491 of the Code of Criminal Procedure or the old prerogative writ of Habeas Corpus.
