The Appellate Division observed that the evidence of the witnesses relied on by the learned Sessions Judge has been established beyond the shadow of doubt that the convicts Fazlur Rahman Badal and Tutul are the perpetrators of the crime. In spite of such evidence being on record the High Court Division has entertained imaginary doubts and concluded that 'evidences are dubious and as such, the guilt of the accused are not conclusively proved'.
