Section 40-The alleged tampering with the meter by the company cannot be decided at all in this summary proceeding. It is essentially a matter of evidence and trial. The dispute regarding slow running of the meter of the company because of its alleged tampering or interference should be resolved through arbitration as envisaged by section 40 of the Act. Since the alleged tampering with the meter is a contentious issue between the parties, the writ petition is not maintainable.
