Both the parties adduced some witnesses in order to prove their respective cases. The trial court, on consideration of evidence and facts and circum- stances, opined that since the deceased employee did not select any nominee for the provident fund and other service benefits these benefits will be distributed among the heirs of the deceased as per Muslim Law of inheritance and or- dered for issuance of succession certificate in favour of the petitioners and the opposite party No. 1 accordingly.
