Regulation 28 

The Additional paper book which has been filed before this court and not controverted by respondent No.1 discloses that the proceeding was instituted, the appointment of the Inquiry Officer was made, the charge-sheet was framed, the inquiry was concluded and the second show cause notice was served all by and at the instance of the General manager (Administration), while the order of dismissal was passed by the Board. The Assistant General Manager (Administration) only communicated and served notices etc. Therefore the proceeding against respondent No. 1 and the order of dismissal passed by the competent authorities must be found to have been held in accordance with regulation 28 of the Service Regulations.
