From a plain and simple simple reading reading of the section it is evident that awarding costs is mandatory and the rule is that it shall follow the event that is the result, which means, the losing party shall bear the costs and where the Court directs that any costs shall not follow the event, the Court shall state its rea- sons in writing. The facts, leading to the filing of this petition, in brief, are that the plaintiffs filed the suit against the Government for declaration of their title to the suit land. The plaintiff's case is that the suit land along with other land originally be- longed to Kasirun Nessa Chowdhury, wife of Sohrab Ali Chowdhury.
