20 BLC 618: Fozor Ali (Md) & others Vs. Md. Anser Ali Sarder & others: Section 115(4) of the Code of Civil Procedure: To avoid any prejudice to the plaintiffs in the suit the learned Assistant Judge ought to have allowed the applications for time filed by the petitioners for producing witnesses. It is well settled principle of law that the trial Court before disposal of the suit/case should give all possible opportunity to the parties to produce their witnesses. (Para-6, Mr. Justice Sheikh Abdul Awal).



Time limit for payment of adjournment cost

5 XP(AD)158: M.A. Razzaque Vs. Syed Maynul Haq & others: Order 17 Rule 1(4) of the Code of Civil Procedure: That since the trial Court did not give any specific time limit for payment of the adjournment cost of Tk.200/- by the plaintiffs, the suit was not liable to be dismissed as per Order 17 Rule 1(4) of the Code of Civil Procedure. (Para-5, Ms. Justice Nazmun Ara Sultana).
