Court may award costs even against a person not a party to the suit if he is given opportunity of being heard.Habib vs Shah. 35 DLR (AD) 72: 1983 BLD (AD) 43: 1983 BCR(AD)52.

Compensatory costs was awarded in the election petition which was not only frivolous, but also vexatious. Zia vs Election Commission. 43 DLR 9: 1990 BLD 386. 

In a civil revision compensatory costs was awarded considering the condition of the petition as vexatious. Abdur vs Iqbal. 49 DLR (AD)142.
