Conversion of memo of appeal into a memo of revision

A time barred appeal was filed under section 30 of the Special Powers Act challenging an order of conviction and sentence. Since the Special Powers Act makes no provision for condonation of delay, section 5 of the Limitation Act not being made applicable to Special Powers Act cases, the convict was left with no remedy for vindication of his grievances. By exercising inherent power under section 561A Cr.P.C. the High Court Di- vision converted the memo of appeal into a memo of revision to examine the legality and propriety of the impugned order of conviction for securing the ends of justice.
